Discovery documents and our research into Rockland County elections revealed that election results are different at the County and State level, and that many security vulnerabilities exist, including the fact that inspectors take the password to the voting machines home with them after orientation.
The judge acknowledged that there is such a thing as organizational standing, but did not grant us that status. Our attorney disagrees and says that we do have organizational standing.
The judge also minimized and misquoted the actual discrepancies in Rockland County in her ruling.
We will put out a press release with many of the findings that have been revealed in Discovery. We actually just received a new batch of discovery documents today that we will be reviewing.

NEW CITY, NY / ACCESS Newswire / June 26, 2025 / SMART Legislation, the lead plaintiff in a seminal case questioning the accuracy of the 2024 Presidential and Senate election results in Rockland County, New York, submitted fifteen pages of document requests and a series of questions to the Rockland County Board of Elections, as part of the discovery process this week.
SMART Legislation is the action arm of the nonpartisan nonprofit SMART Elections. Both organizations are dedicated to ensuring fair and accurate elections.
Discovery Requests Include Software, Hardware, and Password Protocols
Due to irregularities listed in the initial complaint, plaintiffs are seeking evidence about how the election was conducted. Documents requested include information about voting machines; voter rolls; software; software updates; hardware, including forensic grade copies of hard drives; diagrams of all equipment, including network and Wi-Fi components; and flash drives that carry election results.
The document requests also cover security protocols, such as rules for password creation and chain of custody procedures; lists of workers; financial interactions, such as vendor contracts; and communications with voting machine manufacturers, including Elections Systems & Software (ES&S) and the testing lab Pro V&V, among others.
Inquiries About Starlink
Plaintiffs additionally presented the Board with the first in a series of inquiries including questions about modem, Wi-Fi, or cellular connections to Rockland County's election systems; whether the county was using either Starlink's Direct to Cell service, or a program known as Ballotproof[1]; and if any irregularities in the 2024 election were reported or investigated.
Discovery is proceeding at the direction of Judge Rachel Tanguay of the New York Supreme Court, who ruled in the lawsuit's first hearing on May 22nd, that discovery would proceed....

NEW CITY, NY / ACCESS Newswire / May 29, 2025 / A seminal case questioning the accuracy of the 2024 Presidential and Senate election results in Rockland County, New York, is moving forward. In open court last Thursday, Judge Rachel Tanguay of the New York Supreme Court, ruled that discovery must proceed, pushing the lawsuit brought by SMART Legislation into the evidence-gathering stage. The lawsuit seeks a full hand recount of the Presidential and U.S. Senate races in Rockland County.
SMART Legislation, the action arm of SMART Elections, is the lead plaintiff in the case. Both organizations are dedicated to ensuring fair and accurate elections.
“There is clear evidence that the senate results are incorrect, and there are statistical indications that the presidential results are highly unlikely,” stated Lulu Friesdat, Founder and Executive Director of SMART Legislation. “If the results are incorrect, it is a violation of the constitutional rights of each person who voted in the 2024 Rockland County general election. The best way to determine if the results are correct is to examine the paper ballots in a full public, transparent hand recount of all presidential and senate ballots in Rockland County. We believe it’s vitally important, especially in the current environment, to be absolutely confident about the results of the election.”
As stated in the complaint, more voters have sworn they voted for independent U.S. Senate candidate Diane Sare than the Rockland County Board of Elections counted and certified, directly contradicting those results. Additionally, the presidential election results exhibit numerous statistical anomalies. The anomalies in the presidential race include multiple districts where hundreds of voters chose the Democratic candidate Kirsten Gillibrand for Senate, but where zero voters selected the Democratic Presidential candidate Kamala Harris....

Court Challenge Charges Gross Irregularities and Reports of Bribery in Harlem Election
New York, NY – SMART Elections and its Co-founder and Executive Director, Lulu Friesdat, are lead plaintiffs in a lawsuit filed Thursday, October 17th, against the New York City Board of Elections (NYCBOE).
A second judge has recused himself in our New York City corruption case.
This is a clear indication that our case is consequential and has merit.
If the judges thought it was a flimsy case, they would have dismissed it.
But they realized the case has serious implications.
We are discussing options with the attorneys advising us, so that we can bring the facts of this corrupt election to the public.
This case has many similarities to the 2024 Presidential election.
For example, in the voting machines that were audited in this election (2024 June NYC Democratic Primary), the winning candidate has a much higher vote total (15% more) in Early Voting than on Election Day.
In the 2024 Presidential election, some states, like Nevada, according to an analysis done by the Election Truth Alliance, show a much higher vote total for Trump in Early Voting, than on election day.
These type of correlations between elections need to be studied further.
Litigation and legal fees are expensive. However at this point we believe that the courts are one of the main avenues open to us to improve U.S. elections. Many of the problems with U.S. elections have been brewing for years, including: poor election security, poor oversight of elections run by highly partisan election officials, show-boat audits & very little transparency. Our work addresses all of these issues.
